Under the Influence
(D.U.I.)
If you have been arrested for drunk driving or driving under the influence,
DUI, you need a lawyer. There are many legal defenses that only a lawyer can
evaluate. An arrest does not mean a conviction. In 2004, Almost 70,000 DUI
violations were issued. However, according to the Florida DMV, there were
only about 45,000 DUI convictions. That means 25,000 people were NOT convicted,
or 35% of all arrests did not lead to conviction for DUI. Hiring an attorney

You may have a legal defense and be able to
avoid conviction if any of the following apply.
You had very little to drink or refused provide
a breath test.
The police failed to advise you of your rights.
You didn't understand the police advise about the law regarding performing
roadside tests and taking a breath test.
You had a cold, condition, illness or injury that may cause difficulties in
performing physical tests or your balance.
The police had you perform the sobriety tests
on a surface that wasn't flat, dry, well-lit, and totally free of debris.
The lights of the police car blinded or disoriented you when you performed
the tests.
The police had you attempt the tests on or near the road and passing cars.
The police officer did not properly and clearly give you instructions on how
to perform the tests.
Did the police officer physically demonstrate the test before he asked you
to perform the test?
Did the officer mistake your exhaustion or lack of sleep for impairment?
Do you have diabetes, hypoglycemia, or any medical
condition causes you to appear impaired? 
Were you involved in a traffic crash? Did you hit your head on the windshield?

test?
Did the officers ask you to remove your removable
dental work and rinse your mouth before giving you the breath test?
